Important Changes to Buy America Requirements for

Federally Funded Contracts (April 2023)

The Infrastructure Investment and Jobs Act (the “IIJA” more commonly known as the “Infrastructure Bill”) made significant changes to Buy America requirements via the Build America, Buy America Act (“BABA”).  See Pub. L. No. 117-58, §§ 70901-27.  Construction materials covered by BABA, which must now be produced in the United States, include non-ferrous metals, plastic and polymer-based products (including PVC, composite building materials, and polymers used in fiber optic cables), glass (including optic glass), lumber, and drywall. The list of covered construction materials may be expanded in the forthcoming implementing regulations.

Prospective bidders and proposers are encouraged to familiarize themselves with new and developing BABA guidance issued by the federal government, including the Notice of Proposed Guidance issued by the Office of Management and Budget (OMB) and published in the Federal Register on February 9, 2023, which may be viewed at:  https://www.federalregister.gov/documents/2023/02/09/2023-02617/guidance-for-grants-and-agreements

SOLE SOURCE PROCUREMENT

MTA C&D intends to purchase the following item(s) without competitive bidding from the only known source(s).  Any other firm may assert its potential to supply the item(s) by notifying the designated MTA C&D Contact in writing within 5 business days of this notice. 

Contract #: W-32183

Description:  Contractor will be required to develop, furnish, install, test and place in-service a complete web browser-based application solution that will allow MTA end users to interface with the Automatic Train Supervision system for NYCT’s B Division (“ATS-B”) through a standard web browser in addition to the existing dedicated ATS-B workstations in MTA’s subway system (“Thin Client”).  In addition to providing the Thin Client, the Contractor will be required to provide software to replace the existing Integrated Train Register Activity Console (“I-TRAC”) application currently used by NYCT at existing ATS-B workstations in the field and at signal towers locations. This Contract also requires the Contractor to enhance the ATS-B Trip Editor that was provided under Queens Boulevard West, so that the Trip Editor can fully replace the functionality of I-TRAC.

Term of Contract: 548 days
